Use of Site and Prohibited Uses

The Site are made available to you to provide you with information about Greiner Buildings’ products, services, and employment opportunities. No other uses of ours Site is permitted. Harassment in any manner or form on our Site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS GREINER BUILDINGS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS (COLLECTIVELY THE “INDEMNIFIED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, COSTS OR DEBT, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS’ FEES) THAT ARISE OR RESULT FROM:

• Your violation of these Terms of Use,
• Your violation of any third party right,
• Your negligence.

This defense and indemnification obligation will survive termination of these Terms & Conditions and your use of the Sites.

However, even if the third party is affiliated with Greiner Buildings, Greiner Buildings has no control over these linked sites, all of which have separate privacy and data collection practices. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Greiner Buildings seeks to protect the integrity of its Site and the links placed upon it, and therefore, requests feedback on its Site and sites that link to the Site as well.

Miscellaneous

These Terms of Use comprise the entire agreement between you and Greiner Buildings with respect to your use of the Site and supersede all prior agreements. These Terms of Use shall be governed by the laws of the State of Iowa. Any claim must be brought within one year of the date on which the claim arises.

Any dispute shall be resolved only in the Iowa District Court for Linn County or the United States District Court for the Northern District of Iowa (Cedar Rapids Division).

If any provision is declared illegal or unenforceable, the remaining provisions shall continue in full force and effect. Greiner Buildings shall be entitled to specific performance for any breach. No waiver of any term shall be deemed a further waiver of such term or any other term.
